Terms and Conditions

The terms "We", "Us", "Our", or "Company" individually and collectively refer to Learnture Ventures Pvt. Ltd., trading as Board Infinity. We operate the Board Infinity service at www.boardinfinity.com and the InfyLearn learning platform, including white-labelled tenant instances provided to partner institutions (together, the "Service"). The terms "Visitor" and "User" refer to the users of the Service.

These Terms and Conditions govern your access to and use of the Service. Please read this page carefully. By accessing or using the Service, or by creating an account, you agree to these Terms and Conditions and to our Privacy Policy. If you do not accept these Terms, please do not use the Service. We reserve the right to revise these Terms and Conditions at any time by updating this posting; where a change is material we will notify you before it takes effect. You should visit this page periodically, because these Terms are binding on all users of the Service.


ELIGIBILITY

The Service is intended for users who are 18 years of age or older. By using the Service, you confirm that you are at least 18 and are able to enter into a legally binding contract. If you use the Service on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms.


ACCOUNTS AND REGISTRATION

You must provide accurate and current information when you register and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use at admin@boardinfinity.com. We may suspend or refuse an account that violates these Terms.


THE SERVICE

We provide access to online learning programmes, coaching, assessments, and career and placement services. Specific programme inclusions, schedules and outcomes are described at the point of enrolment. Placement and interview opportunities are facilitated, not guaranteed, and depend on employer decisions and on your participation.


FEES, PAYMENT AND REFUNDS

Fees for paid programmes are displayed at the point of purchase and are payable through our third-party payment provider. Applicable taxes are added as required by law. You may request a refund within 7 days of enrolment, provided you have not accessed more than 25% of the programme content, unless a different refund policy is stated for the specific programme you purchased, in which case that policy applies. Except as stated in the applicable refund policy or as required by law, fees are non-refundable.


USE OF CONTENT

All logos, brands, marks headings, labels, names, signatures, numerals, shapes or any combinations thereof, appearing in this Service, except as otherwise noted, are properties either owned, or used under licence, by the Company and / or its associate entities who feature on this Service. The use of these properties or any other content on this Service, except as provided in these terms and conditions or in the site content, is strictly prohibited.

You may not sell or modify the content of this Service or reproduce, display, publicly perform, distribute, or otherwise use the materials in any way for any public or commercial purpose without the respective organisation's or entity's written permission.


USER CONTENT

You retain ownership of the content you submit to the Service, such as assignments, submissions and profile information. You grant us a limited, worldwide, royalty-free licence to host, store, process and use that content solely to provide and improve the Service. You are responsible for ensuring that you have the rights to submit the content and that it does not infringe the rights of others.


ACCEPTABLE WEBSITE USE

(A) Security Rules

Visitors are prohibited from violating or attempting to violate the security of the Service, including, without limitation, (1) accessing data not intended for such user or logging into a server or account which the user is not authorised to access, (2) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorisation, (3) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus or "Trojan horse" to the Service, overloading, "flooding", "mail bombing" or "crashing", or (4) sending unsolicited electronic mail, including promotions and/or advertising of products or services. Violations of system or network security may result in civil or criminal liability. The Company and / or its associate entities will have the right to investigate occurrences that they suspect as involving such violations and will have the right to involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

(B) General Rules

Visitors may not use the Service in order to transmit, distribute, store or destroy material (a) that could constitute or encourage conduct that would be considered a criminal offence or violate any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy or publicity of other personal rights of others, or (c) that is libellous, defamatory, pornographic, profane, obscene, threatening, abusive or hateful.


THIRD-PARTY LINKS AND SERVICES

The Service may link to or integrate third-party websites and services. We are not responsible for their content, terms or practices, and your use of them is at your own risk and subject to their terms.


DISCLAIMER

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including as to availability, accuracy, or fitness for a particular purpose, to the maximum extent permitted by law.


INDEMNITY

The User unilaterally agree to indemnify and hold harmless, without objection, the Company, its officers, directors, employees and agents from and against any claims, actions and/or demands and/or liabilities and/or losses and/or damages whatsoever arising from or resulting from their use of www.boardinfinity.com or their breach of the terms.


LIABILITY

User agrees that neither Company nor its group companies, directors, officers or employee shall be liable for any direct or/and indirect or/and incidental or/and special or/and consequential or/and exemplary damages, resulting from the use or/and the inability to use the service or/and for cost of procurement of substitute goods or/and services or resulting from any goods or/and data or/and information or/and services purchased or/and obtained or/and messages received or/and transactions entered into through or/and from the service or/and resulting from unauthorized access to or/and alteration of user's transmissions or/and data or/and arising from any other matter relating to the service, including but not limited to, damages for loss of profits or/and use or/and data or other intangible, even if Company has been advised of the possibility of such damages.

User further agrees that Company shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct or/and indirect or/and incidental or/and special consequential or/and exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent.

User agrees that Company shall not be responsible or liable to user, or anyone, for the statements or conduct of any third party of the service. In sum, in no event shall Company's total liability to the User for all damages or/and losses or/and causes of action exceed the amount paid by the User to Company, if any, that is related to the cause of action.


DISCLAIMER OF CONSEQUENTIAL DAMAGES

In no event shall Company or any parties, organizations or entities associated with the corporate brand name us or otherwise, mentioned at this Website be liable for any damages whatsoever (including, without limitations, incidental and consequential damages, lost profits, or damage to computer hardware or loss of data information or business interruption) resulting from the use or inability to use the Website and the Website material, whether based on warranty, contract, tort, or any other legal theory, and whether or not, such organization or entities were advised of the possibility of such damages.


TERMINATION AND SUSPENSION

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or where required by law. On termination, the provisions that by their nature should survive — including USE OF CONTENT, LIABILITY, INDEMNITY and GOVERNING LAW AND JURISDICTION — continue to apply. Your rights over your personal data on account closure are set out in our Privacy Policy.


PRIVACY

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use and protect your personal data under the Digital Personal Data Protection Act, 2023.


GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by and construed in accordance with the laws of India. Subject to the DISPUTE RESOLUTION clause below, the courts at Navi Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service.


DISPUTE RESOLUTION

If a dispute arises, please first contact us at admin@boardinfinity.com so that we can try to resolve it amicably. Any dispute that is not resolved may be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, with the seat and venue of arbitration at Navi Mumbai, Maharashtra, and conducted in English, before recourse is had to the courts identified above.


CHANGES TO THESE TERMS

We may update these Terms and Conditions from time to time. The current version, with its effective date, is always posted on this page. Material changes will be notified where required, and your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
